Welcome to F33LZ, a product of The Brewz LLC, DBA F33LZ ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the F33LZ mobile application, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility and Age Requirement
F33LZ is strictly for users who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We require age verification during the onboarding process. If we determine that you are under 18, your account will be immediately terminated and your data deleted.
2. Your Account and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You must notify us immediately of any unauthorized use of your account.
3. User-Generated Content (UGC) and Acceptable Use
F33LZ allows you to record voice entries, create transcripts, and interact with others. You retain ownership of your content, but you grant F33LZ a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content for the purpose of operating and improving the Service, subject to your privacy settings and our Data Consent Policy.
You agree NOT to use the Service to:
- Post, record, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Share personal information of others without their explicit consent.
- Engage in spamming, phishing, or other unsolicited communications.
- Upload or transmit viruses, malware, or other malicious code.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to gain unauthorized access to the Service, other users' accounts, or computer systems.
- Use the Service for any commercial purpose without our prior written consent.
4. Moderation, Reporting, and Enforcement
F33LZ employs a layered moderation approach, including automated speech-to-text analysis, safety classifiers, and human review, to enforce these Terms.
- Reporting: You can report any user or content that violates these Terms using the in-app reporting tools. We review reports promptly and take appropriate action.
- Blocking: You can block any user from interacting with you or viewing your content.
- Enforcement: We reserve the right, at our sole discretion, to remove any content, suspend or terminate your account, or take other appropriate action if we believe you have violated these Terms or engaged in harmful conduct.
5. Physical Products (Yearbook/Diary)
F33LZ offers the option to purchase a physical printed "Yearbook/Diary" containing your transcripts and emotional data. These purchases are processed through our publishing partner at openkimonopublishing.com/f33lz, outside of the standard Apple App Store or Google Play in-app purchase systems.
You are solely responsible for reviewing and redacting any sensitive or private information from your transcripts before finalizing your order. F33LZ is not responsible for any regret or harm resulting from the inclusion of such information in your printed book.
6. Intellectual Property
The Service and its original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of F33LZ and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. F33LZ EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
IN NO EVENT SHALL F33LZ, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
9. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Colorado.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
